MINUTES OF THE REGULAR MEETING OF COUNCIL

1.                  CALL TO ORDER

 

The Mayor called the meeting to order at 7:00 p.m.

 

2.                  APPROVAL OF THE AGENDA

3.                  PUBLIC HEARINGS

 

a)  BYLAW NO.  489 (File No. 3900-489)                                                                               

                  “Langford Zoning Bylaw, Amendment No. 32, (628 Atkins Avenue), 2000".

 

The Mayor opened the Public Hearing for Bylaw No. 489 at 7:01 p.m.

 

The Municipal Planner briefly outlined the purpose and designation of the proposed bylaws and confirmed that the Notice of Public Hearing had been advertised in the July 5, 2000 and July 12, 2000 issues of the Goldstream Gazette and that notices were sent to properties adjacent to the property to be rezoned.

 

Mayor Young called for presentations.

 

Mayor Young called a second time for presentations. 

 

The Mayor called for a third and final time for further presentations. There being none, the Mayor officially declared the Public Hearing for Bylaw No. 489 closed at 7:03 p.m.


                       

b)     BYLAW NO. 490 (File No. 3900-490)                                                                               

      “Langford Zoning Bylaw, Amendment No. 33, (636 and 650 Hoffman Avenue), 2000".

 

The Mayor opened the Public Hearing for Bylaw No. 490 at 7:03 p.m.

 

The Municipal Planner briefly outlined the purpose and designation of the proposed bylaws and confirmed that the Notice of Public Hearing had been advertised in the July 5, 2000 and July 12, 2000 issues of the Goldstream Gazette and that notices were sent to properties adjacent to the property to be rezoned.

 

Mayor Young called for presentations.

 

Ms. Mary Johannesen of 2600 Rainville Road addressed Council and congratulated Council on their work in the District of Langford such as sidewalks.  Ms. Johannesen has concerns for school children starting school in September of increased traffic, specifically in the area of the Millstream/Hoffman intersection created from the proposal. 

 

The Municipal Engineer advised that the Minister of Transportation and Highways was responsible for Millstream Road and they had indicated they may consider a dedicated left out or right out off onto Millstream Road from Hoffman Road, which would help to alleviate the traffic congestion.

 

Mayor Young advised Ms. Johannesen that a letter from herself and residents in the neighbourhood to the Ministry of Transportation and Highways and to the MLA with her concerns would be helpful to the municipality to correct the situation.

 

Ms. Johannesen expressed her concern, with young families moving into the area, the lack of park space within walking distant in the neigbhourhood for children to play.  She feels that tot lots are inadequate for a park playground and requested Council to reassess the tot lot.

 

Mayor Young called a second time for presentations. 

 

Ms. Caroline Rutledge of 2620 Rainville Road addressed Council and advised of her appreciation for the work Council had done with improvements in the District of Langford.  Ms. Rutledge would support the proposed development with the provision of a play park for children.  As Ms. Rutledge is a ‘one car family’, she requested Council to consider developing a proper play park for children within walking distance to the neighbourhood residents in the area. 

 

Mayor Young advised the developer had donated 5% parkland, sidewalk and road improvements as required by OCP guidelines. 

 

Ms. Johannesen  advised she felt it was necessary to create more parks in neighbourhoods that are walking distance for parents and children and suggested a tradeoff of sidewalks for park.

 

Mayor Young advised that other residents in the area wanted sidewalks and sewers and that negotiations have been on going. Council is looking for a good development in this area.

 

Councillor Goudy advised that Veterans Park would be created soon.

 

Mr. Winston Boulter of 2642 Wentwich Road  requested assurance from the developer that he would supply a pre-blast inspection of his house, as his house is located next door to the proposed development.

 

Mayor Young advised that a pre-blast inspection would be a condition of development.

 

Mr. Boulter asked Council if there were plans to extend the sewer in that area.

 

Mayor Young advised Mr. Boulter that he and his neighbours could petition Council for sewers in their area.

 

Mayor Young called a third time for presentation.

 

Ms. Carla Cuthbertson of 630 Hoffman Avenue addressed Council of her concerns with the construction next door.  Ms. Cuthbertson requested a privacy fence around her property as 3 homes are boarding her property.

 

Mayor Young advised that Ms. Cuthbertson that a privacy fence would be a condition of the rezoning.

 

Ms. Cuthbertson also had traffic concerns and requested that the speed limit be reduced or speed bumps installed.

 

Ms. Donna Cowen of 2724 Rainville Road addressed Council and advised that she operates a day care on Atkins Road, and has lived there for the past 11 years.  Ms. Cowen is concerned with the speed of the traffic on Rainville Road, and requested the speed limit to be lowered to help alleviate the problem.

 

The Municipal Engineer advised that it would be more effective to change the Hoffman/Winster intersection to deter the speed of traffic.

 

Mayor Young advised that sidewalks will be installed on Hoffman Avenue and the Engineer already has plans for physical traffic calming measures on Hoffman at Winster and will look for ways to extend this.

 

Mayor Young advised that the Engineer will find a solution to help mitigate the situation and that a sidewalk would be installed on the left hand side of Hoffman Road.

 

The Mayor called for a third and final time for further presentations.  There being none, the Mayor officially declared the Public Hearing for Bylaw No. 490 closed at  7:33 p.m.

6.                  PUBLIC PARTICIPATION

 

Ms. Elaine Cox of 2620 Crystalview Avenue addressed Council and advised of her concern with Development Variance Permit 00-04 and the public perception that the statutory right-of way on her property was open to the public, and further the right-of way on her property is a CRD Water access not a Fire Lane.

 

Mayor Young advised Ms. Cox that in an emergency fire trucks have access anywhere there is a passable road in Langford.

 

Ms. Cox asked whether the developer would be upgrading the lane.

 

The Municipal Engineer advised Council that if the road was passable it would not be necessary to do any work on her property.

 

Mayor Young advised Ms. Cox that the Fire Chief would be responsible for the decision on the whether the road would require upgrading, and that if upgrading is required, the owners of the property would be advised before any work was done.

 

Ms. Deidre Hill of 2668 Selwyn Road, Western Community Arts Council President, addressed Council with a verbal presentation on the Arts Community and requested financial support .

 

Mayor Young advised Ms. Hill that Langford Council had supported the Arts in the past and did so hoping that other Western Community Councils would also take the imitative.  Mayor Young asked which municipalities had contributed.

 

Ms. Hill replied that the Highlands had donated $450, Colwood donated last year $500, but nothing this year and Metchosin donates to the Arts Council in Victoria.

 

Mayor Young advised that funding of the School Crossing Guards was a priority this year.  Langford had funded the Arts Council higher than any other municipality hoping the other municipalities would take the initiative.  We are now having to take money directly out of taxation.  Langford will continue to try and fund the Arts Council, and hopefully Langford will receive money from developers to help pay for School Crossing Guards and allow Langford to contribute more to the Arts Council.

 

Mayor Young advised that Council would fund a minimum of $6,000 and if we receive support from a developer for School Crossing Guards, Council will fund the Arts Council for $9,000.  Mayor Young advised Ms. Hill  that Langford would have a referendum at the next election to see if people would like to fund the arts and pay for it through taxation.

 

Mr. Robert John of 2607 Crystalview Drive presented pictures to Council of what his property and neighbourhood looked like before and after the development.  Mr. John advised that the developer owned the lot next door to him and the developer used the lot as a storage area for rocks and dirt, and over the past 2.5 years he had lived with the dust and dirt and was fed up with the mess.  He advised the developer never cleans the streets and dumping starts as early as 7:00 a.m.  Mr. John requested that the hours of work be clarified before the application was approved.  He also requested a reduction in the speed limit.

 

Mayor Young advised that the Municipal Engineer would speak to the developer with respect to the Noise Bylaw and have the street cleaned. 

 

Mayor Young advised Mr. John write a letter to Council with the support of his neighbours to reduce the speed to 30KM.

 

Ms. Bonnie Rennie of the Western Arts Council addressed Council and gave a preview of some of the art banners that would be hung on Jacklin Road.

 

Mr. Richard McDowall of 3401 Yorkshire Place addressed Council and asked if there was hunting allowed in Langford.

 

Mayor Young advised Mr. McDowall that there was bow hunting and that we are in the process of regulating it.

 

Mr. MacDowall asked Council why a year ago they had banned hunting.

 

Councillor Maxwell advised Mr. MacDowall that Council had banned hunting but rescinded the resolution as there had been no consultation with the hunters, and the issue is being revisited.

 

Mr. MacDowall advised Council that he is opposed to bow hunting.

 

Mayor Young advised Mr. MacDowall that Council was trying to compromise between both parties and that Council was in the process of  defining the bow hunting area.

 

Mr. Murray Daly of 678 Atkins Road addressed Council with his opposition to restricting bow hunting.

 

Ms. Nitya Harris of 3182 Humpback Road  addressed Council in appreciation of the decision that had been made at the Protective Services Committee regarding restricting bow hunting south of the Trans Canada Highway.


 

7.                  DEVELOPMENT VARIANCE PERMIT

 

a)  DVP-00-06 – 920 Dunford Avenue to Allow Above Ground Electrical Service

That Council for the District of Langford issue Development Variance Permit No. DVP-00-06 to 568788 BC Ltd. (Inc. No. 568788) for the property legally described as Lot 7, Section 79, Esquimalt District, Plan 13718, PID No. 004-612-922 (920 Dunford Avenue), subject to the following terms and conditions:

 

1.      Variances

 

The following Subdivision Bylaw regulations are varied under Section 922 of the Municipal Act:

 

a.      Section 12.5 of Subdivision and Development Servicing Bylaw No. 500 is varied by eliminating the requirement that the extension of electrical, telephone and other services supplied through wires, be provided underground, subject to these services being provided instead via overhead wires.

3.      Amendments to Greater Victoria Public Library Operating Agreement (File No. 7960-02)

b)   That Council consent to the Greater Victoria Public Library entering into Agreements for extended service to the Peninsula municipalities should they apply.

5.  School Crossing Guard Funding (File No. 0490-05)

That Council advise the Sooke Parents Education Advisory Council (SPEAC)that  the Crossing Guards will be funded from the Council Contingency fund;

AND that if developer contributions are not received,  $3,000 will be reallocated from Cultural (Western Communities Arts Council) grants to School Crossing Guards for September to December 2000.

b)  Protective Services Committee – June 27, 2000       

1.      Bow Hunting (File No. 7710-15)

That Council ban bow hunting south of the Trans Canada Highway and notify property owners on the north side of the Trans Canada Highway proposed bow hunting area to consider granting permission to allow bow hunting on their property.

2.   Visible Address Campaign  (File No. 7130-01)

That Council approve the Visible Address Campaign as follows:

a)      That the Fire Department provide reflective number signs (at $10 over cost) to be installed (by the property owner) at the end of driveways, by:

i)                    entering into a non-binding agreement with Trans Sign to supply us the sign posts complete with reflective backing and appropriate stick on reflective numbers, at a confirmed price, and

ii)                   the profits we make on each to be forwarded to the Muscular Dystrophy Association of Canada as part of our annual fundraising.

1.  Development Variance Permit Application – 2604 Crystalview Drive   

 (File No. DVP-00-04)

That Council proceed with DVP-00-04 for the property at 2604 Crystalview subject to:

i)        The registering of a s. 219 covenant that would require residential fire sprinkler systems in accordance with NFPA 13 D-6 standards to be installed in all buildings over 100 m² in area if the available fire flows are less than 2 700 l for 2 hours;

ii)       the registering of a s. 219 covenant that would require a minimum 5.5 metre driveway (net of sidewalks) in front of the garages of proposed Lots 16, 17, 18, 19, 20, 21 and 26;

iii)   the development of a “tot lot”  with fencing on the proposed Lot 48; and

iv)  lots 24, 25 and 26 be reconfigured as two lots.

 

      with the following variances:

 

a)      Section 7.2 of Subdivision and Servicing Bylaw 190 is varied to reduce the required road        right of way width from 18 metres to 12 metres;

b)      Section 7.3.2 of Subdivision and Servicing Bylaw 190 is varied to reduce the required radius for a cul de sac right of way from 15 m to 13 m for proposed Road B;

c)      Section 7.3.1 of Subdivision and Servicing Bylaw 190 is varied to reduce the required paved area of a cul de sac from 13 m radius to a 12 m radius for proposed Road B;

d)      Section 7.3.1 of Subdivision and Servicing Bylaw 190 is varied to reduce the required radius for a cul de sac island from 6 m to 0 m for proposed Road B;

e)      Section 9.3 of Subdivision and Servicing Bylaw 190 is varied to reduce the required     pressure for fire flows from 2700 lpm to 2580 lpm.

f)        Section 1.01.01 of Zoning Bylaw 300 is varied to define the front lot line for proposed Lot         30 as the property line adjacent to Proposed Road A; and

g)      Section 6.21.06 (1) (a) of Bylaw 300 is varied to reduce the required distance from the            front lot line from 6.0 m (20 ft) to 4.5 m (12 ft) on proposed Lots 16, 17, 18, 19, 20, 21   and 26.

v.    Light industrial uses which are not noxious or offensive by reason of permitting odours, dust, smoke, gas or noise, including but without limiting the generality of the foregoing establishments for the following trade contractors: building, electrical, heating and air conditioning, painting, plumbing, refrigeration, roofing, septic tank and signs. The following uses are specifically excluded:

(a)   any use specified in the Health Act as an offensive trade;

(b)   auto wrecking;

(c)   gravel processing;

(d)   refuse and garbage dumps; and

2.                  The Ministry of Transportation and Highways be asked to bring all of their open ditch drainage rights of way to an acceptable standard or provide the District with a one time payment of $60,000 (or some other amount) to cover this work and the Mayor and Clerk Administrator be authorized to then sign the required documents to accept, individually, all the open channel drainage rights-of-way from the Ministry; and
